First things first: Clients, not designers, own and pay for licenses based on their company size. When measuring company size, we're looking at the TOTAL number of employees in the company, not the number of users or the size of the in-house design team. This also means that there is no need to analyze web traffic, downloads, or the number of computers on which fonts will be installed Ð the client's company size is key. Who is who: License Owner Client Primary Designer You Secondary Designer Any subcontractor that might also use the font(s) for the license owner. This contract covers all font use. After payment and agreement, the License Owner gains a non-exclusive, non-transferable license. Ownership stays with Raoul Gottschling, and any rights not explicitly granted herein are reserved. Each client must hold its distinct license. If you (the designer) are using a font for two different clients, an individual license has to be acquired for each of them. Your invoice specifies your purchased license type. A license upgrade is required if the License Owner surpasses the Company Size indicated in your invoice's License Metrics section. Apart from this, fees are one-time; no subscriptions apply. The types of Licenses: Desktop / Print: Install fonts on devices for creating digital and printed content within one brand. Logo / Wordmark: Design logos/wordmarks for a brand. Use anywhere. Separate license needed for other brands. Social Media: Create assets for one brand's social media. Additional video license required for video content. Web: Use fonts on one domain via @font-face CSS. There is no limitation on traffic, but separate license required for other domains. App / Game: Embed fonts in one app/game. Additional licenses needed for more apps/games. Video / Broadcast: Create animated/moving content. Needed for YouTube, Netflix, your local TV station, etc. If this content is shared on social media, a social media license is needed. Trial: Free trial with full character set. Assess fonts or pitch design ideas Student: Student licenses are free, as long as fonts are only used for school projects. If your school is participating in a paid project, regular licensing fees apply. Fonts can't be... ¥ ...used in political context without consent by Raoul Gottschling. Please reach out BEFORE purchasing a license. ¥ ...used in projects / for clients that promote violence or discrimination ¥ ...converted to different formats ¥ ...modified or reverse engineered ¥ ...used as a base for your own typeface designs ¥ ... shared with third parties without acquiring a third party license ¥ ... hosted on public servers is disallowed or otherwise shared publicly. In case of contract breach, all rights cease, and font usage must halt. Besides potential legal actions, you're liable for costs incurred, including legal fees, investigations, and settlements. Warranties, etc. Fonts are provided "as-is" without implied warranties. You confirm contract eligibility and non-harmful font use. Indemnify Raoul Gottschling against losses from breaches. Neither party is liable for indirect or consequential damages. Raoul Gottschling's liability is limited to fee refund. Fonts are well-tested, but issues may arise. Please get in contact in case of any doubt. This agreement supersedes prior discussions, modifiable only in writing. Unenforceable parts will be replaced; waived rights aren't recurrent. German law governs, with exclusive Berlin jurisdiction. International sales conventions and conflict of law principles don't apply. You're responsible for taxes in your country; we won't pay or deduct them. |
